Customs Appellate Tribunal orders release of seized mobile phones to lawful owner

LAHORE: The Customs Appellate Tribunal has ordered the release of seized goods to its lawful owner in a case of Shahzaib Enterprises versus Collector of Customs Adjudication Lahore.

A show-cause notice was issued to the appellant wherein it was alleged that the Customs Staff at the Allama Iqbal International Airport Lahore, during the checking of the passengers, found 10 suitcases loaded in two trolleys being handled by the two porters. The luggage was checked and the customs staff found it filled with Nokia mobile phones of Chinese origin.

On the bases of facts, the show-cause notice was issued as to why goods should not be confiscated under the various provisions of the Customs Act 1969. The appellant contested the show-cause notice and also filed a reply therein.

The adjudication authority heard the case and passed the Order-In-Original against the appellant.

Complainant, being aggrieved from the order, filed the case before the Customs Appellate Tribunal on the grounds that the customs officers seized the goods illegally and appealed to release items to him whereas the respondent denied all the allegations.

After the verification of all the documents and record, Customs Appellate Tribunal Member Tahir Zia decided the case with remarks that the impugned order is set aside and items be released to the lawful owner.
