Customs Appellate Tribunal adjourns hearing of case challenging seizure of mobile phones

ISLAMABAD: The Customs Appellate Tribunal adjourned the hearing of a customs reference filed against Model Collectorate of Customs, Islamabad, on Tuesday.

A division bench of Customs Appellate Tribunal, Muhammad Nasir Khan and Ziauddin Wazire heard the case filed recently seeking release of seized around a dozen mobile phones.

After hearing initial arguments from the appellant, the bench adjournedthe  hearing for coming week for further arguments.

The appellant, through the case had challenged an announcement made by adjudication of Model Collectorate of Customs, Islamabad about seizure of mobile phones.

Mobile phones first confiscated by the customs authorities at Benazir Bhutto International Airport, Islamabad. The petitioner had brought the mobiles into Pakistan through airport which MCC had declared illegal and in violation of regulations adopted for carrying mobiles phone in luggage.

The MCC authorities had confiscated the mobile phones at the airport and subsequently decided not to release them as the petitioner had violated the rules while returning to Pakistan.  The case was accepted by the tribunal for hearing and will be decided in coming days. The same bench had already heard a couple of cases involving seizure of mobile phones at the airport.

Meanwhile Customs Appellate Tribunal to resume hearing of couple of customs matters involving field offices of Federal Board of Revenue (FBR) on Wednesday.

Customs Appellate Tribunal’s bench comprising Members Tribunal, Syed Muhammad Anwar and Muhammad Nasir Khan will hear the matters.

M/s Kohinoor Traders, M/s Five Star Trading and M/s Warid Telecom Private Limited had filed the references.

During the previous hearing counsels from M/s Kohinoor Traders, M/s Five Star Trading appeared before the bench and demanded timed from the bench for finalizing preparations for the case. The bench then had directed the counsels to finalized the arguments and relating stuff and then appear before the bench next week.

M/s Kohinoor Traders, M/s Five Star Trading had filed cases against Directorate of Intelligence and Investigation, Islamabad.

Meanwhile, the bench sought time to review documents in a case filed by M/S WaridTelecom Private Limited. The company had challenged an announcement made by the Model Collectorate of Customs, Islamabad. The bench adjourned hearing of the case till for next Wednesday.

M/s Warid Telecom Private Limited had filed the case against Model Coollectorate of Customs, Islamabad. The company had filed the case in 2016.

M/s Warid Telecom Private Limited, through the petition, had challenged a decision announced by department’s adjudication for sustaining claims of recoverable customs duty of around Rs 40,000,000.

Tribunal had held hearing of the matter in the recent weeks week and had adjourned for further arguments. Bench had asked the counsels involved ensure their presence before the bench on next date of hearing. M/s Warid Telecom Private Limited had challenged department’s adjudication decision before the bench which had sustained claims on said recoverable amount against the appellant.

M/s Warid Telecom Private Limited’s plea 144/CU/IB/2016 was filed in January. According to tribunal’s officials, the case involved a huge amount in head of taxes.
