Customs Appellate Tribunal rejects appeal in imported plastic items case

LAHORE: Customs Appellate Tribunal on Monday has dismissed appeal in seized imported tableware and kitchenware made in China. The same appeal was filed by Deputy Director Directorate of Post Clerance Audit Lahore against M/s Fasna Impex and others.

Omer Arshed Hakeem, member judicial bench-II heard the arguments and examind the record produced by the appellant and respondent before the court.

After complete hearing of case, judgement is passed with remarks that appellant has failed to prove the allegations and same appeal is dismissed.

As per brief history of case, M/s Fasna Impex was imporeted a consignments of tablewere and kitchenware made of plastic from China and got clearance under wrong PCT Heading allegedly.

After adjudication order, appeal heard by adjudication authority who passed the impugned order with remarks that customs department for recovery of amount of Rs 169020 detected by the department as recoverable against six GDs.

Being aggrived with the order, appeal was filed before the collector of Customs (Appeals)who accepted the same appeal in favour of importer and appeal is accepted and set aisde the order in original passed by earlier autharity.

Not satisfied with the order, appellant department was filed appeal before the Customs Appellate Tribunal that order passed in mechanical fashion without consideration of fact and laws and same is liable to set aside but respondent denied and appeal for rejection of case. After hearing arguments from both sides, Customs Appellate Tribunal has dismissed appeal of department and quashed the appeal.
