Customs Appellate Tribunal rejects appeal in imported PVC Flex Sheets

LAHORE: Customs Appellate Tribunal on Friday has dismissed appeal in seized imported three consignments of PVC Flex Sheets from China. The same appeal was filed by Collector of Customs, Appraisment Lahore against Khurram Azhar and others.

Omer Arshed Hakeem, member judicial bench-II heard the arguments and examind the record produced by the appellant and respondent before the court.

After complete hearing of case, judgement is passed with remarks that appellant has failed to prove the allegations and same appeal is dismissed.

As per brief history of case, M/s Oliver Industries was imporeted three consignments of PVC Flex Sheets from China under the wrong GD number, same goods were seized

After adjudication order, appeal heard by Collector of Customs Appeals who passed the impugned order with remarks that deputy collector order is set aside and goods release to the lawful owner after applying relevent laws.

Being aggrived with the order, appellant department was filed appeal before the Customs Appellate Tribunal that order passed in mechanical fashion without consideration of fact and laws and same is liable to set aside but respondent denied and appeal for rejection of case. After hearing arguments from both sides, Customs Appellate Tribunal has dismissed appeal of department and quashed the order.
