LAHORE: Customs Appellate Tribunal upheld the impugned order in smuggled vehicle case. The appeal filed by Mukhtar Khan, a resident of Peshawar against order passed by the adjudication authority and collector of customs (appeals) is rejected.
According to the details, Imran Tariq, Member Technical Bench-II heard the case in detail and passed the judgement that customs tribunal learnt that the chassis number of smuggled was discarded and new chassis number has welded on the new frame during the course of alteration of the vehicle from bus to truck.
As per details, the staff of customs Anti-Smuggling Organization (ASO) intercepted truck in Bhakkar. On query, driver introduced himself as Khadim Hussain and failed to produce documents regarding lawful import of vehicle. After the technical examination of the vehicle same were seized under the section 168 of the Customs Act 1969.
After necessary procedure a show cause notice case were referred to the adjudication authority who heard the case in details and declared outright confiscation of vehicle. Appellant challenged the order before the collector of customs (appeals) who also examine the facts and upheld the adjudication order also dismissed the appeal.
Being aggrieved from the order, complainant filed the case before the Customs Appellate Tribunal on the grounds that impugned order is harsh and unjustified and early deciding authorities announce order merely on the basis of assumptions.
Further said in the appeal that impugned order of the respondents is also stereo type which is violation of principles of natural justice, complainant prayed before the tribunal for dismissal of early passed order. On the other side, respondents denied all allegations. After completions of arguments from both sides, Tribunal decided the case and rejected the appeal.
