Customs Appellate Tribunal rejects case filed by M/s Yousaf Tanneries versus Customs Adjudication

LAHORE: The Customs Appellate Tribunal has dismissed a case filed by M/s Yousaf Tanneries versus Additional Collector of Customs Adjudication, Air Freight Unit (AFU), Cargo Complex, Allama Iqbal International  Airport Lahore.

Member Judicial bench-II Omer Arshad Hakeem heard the case and dismissed the same with remarks that the appellant has failed to prove his charges, so the decision of Customs Adjudication is justified and according to the law.

Brief facts of case, core controversy involved in the instant appeal that the DTRE user (appellant) requested the PCA directorate for exportation audit. The directorate selected the case for audit, during the audit customs authorities found some discrepancies and some violations such as non submission of reconciliation statement and contractual violations. The audit authorities levied tax and duties that challenged before the adjudication authority by the appellant.

After hearing the case, Customs Appellate Tribunal dismissed the case with order to maintain the decision of adjudication.
