Customs Appellate Tribunal remands back appeal in used machinery case

LAHORE: The Customs Appellate Tribunal has remanded back an appeal in used machinery case which was imported from Korea.

The appeal was filed by Muhammad Saeed, a resident of Sargodha, and Mujahid Hussain versus additional collector Customs adjudication.

Muhammad Shabbir Gujjar, Member Judicial, heard the arguments from both sides, examined the record and passed the judgment to set aside the appeal filed by the appellant, and also remanded back the case to the adjudication authority for fresh speaking orders after providing opportunities to both parties within 30 days.

As per brief history, the case was reported by the Customs Anti Smuggling Oraganization in which smuggled used machinery was seized.

On demand, driver failed to produce documents regarding the lawful imports of goods and same were seized under the relevant section of Customs Act 1969.

Adjudication authority culminated hearings; order in original was passed that re-examination of goods and charged the penalty equal to three time of the value of goods. Being aggrieved from the order appellant filed the appeal before the Customs Appellate Tribunal.

The appellant mentioned in the appeal that adjudication authority has passed the order without hearing of parties. Appellant also produce the all documents showing the illegality of seized items and appeal to set aside the order passed by the earliest authority.

After hearing arguments from both sides, Customs Appellant Tribunal decided the case with remarks that Impugned order is set aside and adjudication authority hear the case for further order.
