Customs Appellate Tribunal reserves verdict on plea filed by M/s Yarkan Int’l

ISLAMABAD: A single bench of the Customs Appellate Tribunal has reserved a decision on a case filed by M/s Yarkan International against Collectorate of Customs, Islamabad.

The single bench comprising Member Technical, Muhammad Nasir Khan heard the case and reserved decision. The bench had heard the case for several times and reserved decision as the parties submitted their replies before the tribunal on the last date of hearing. M/s Yarkan International had challenged a decision announced by the collectorate regarding seizure of imported good.

Earlier the tribunal had adjourned hearing on M/s Yarkan International’s customs reference. Last week the Customs Appellate Tribunal single bench had dismissed Nadeem Khan’s customs case filed against Collectorate of Customs, Islamabad. Member Technical, Muhammad Nasir Khan had dismissed the case in favor of department.  Both cases were filed in 2016 and collector customs was made main respondent in the cases.

The same bench had held hearing of these cases couple of weeks ago. Then, the bench had conveyed the department to ensure its presence before the bench.  The hearing was adjourned following absence of department’s main counsel from the tribunal.

Both the appellant had challenged decisions of department’s adjudication before the tribunal pertaining to their imported goods which were seized by the authorities following complaints of misevaluation.

Both parties had denied the seizure of goods claiming that no misevaluation was made while importing the items.
