LAHORE: Customs Appellate Tribunal has set aside the Order-In-Original in case filed by the Director, Directorate of Intelligence and Investigation-FBR Lahore against Gul Khan a resident of Peshawar.
According to the details, Justice ® Malik Manzoor Hussain, Chairman Customs Appellate Tribunal heard the case in details and passed the judgment that appeal filed by the department is allowed and order passed by the earliest forum is set aside and appeal filed by the claimant of bus is dismissed.
As per brief history of case, on the information the staff of Customs Intelligence and Investigation Lahore intercepted bus near Sheikhupura and found foreign origin goods which were smuggled from Peshawar to Lahore.
After completing all legal formalities, cases were referred to the Adjudication Collectorate and said the Collectorate to pass the order after hearing the parties whereby goods were released on the payment of duties and taxes levied thereon along with the redemption fine equal to 20 percent of the assessed value. The bus was release on the payment of redeption fine of Rs1,00,000.
Feeling dis-satisfied from the order Department filed the case before the learned counsel who heard the case in details the case were adjourned twice however the required record was provided and placed on the file.
After perusal of all record and complete arguments from the appellant and as well as respondent side, Customs Appellate Tribunal decided the case with the remarks that the appeal filed by the department is allowed and set aside the order and appeal filed by the claimant is dismissed.
