Customs Appellate Tribunal set aside ONO in seized skin bar soap

LAHORE: Customs Appellate Tribunal on Thursday has accepted the appeal and set aside impugned order passed by the adjudication authority. The appeal was filed by Additional Collector of Customs Preventive Lahore against Muhammad Arshad, a resident of Charsadda.

Justice ® Malik Manzoor Hussain, Chairman Customs Appellate Tribunal examined the record produced by the parties before the tribunal and passed the judgement that Order-in-Original is passed against the facts and set aside.

As per brief history of case, on the credible information staff of Customs Anti Smuggling Orignization intercepted huge quentaty of smuggled goods which were transported from Peshawar to Lahore by a bus.

During the action a passanger threatened the customs officer, same officers called further force and during the checking Skin Glycerin Bar Soap (Indian origin) was recovered and same were seized under the Customs Act 1969 and FIR was registered in Shera Kot Police Station against the owner of same goods..

The same appeal was heared by the adjudication authairty who decided the case to release goods on the payment of reedemption fine.

Same order was not accepted by the customs deparment who filed the case before the Customs Appellate Tribunal with recommendations that Order in Original passed beyond law and liable to set aside. On the other hand, respondent denied allegations and appeal for rejection of case.

After hearing the arguments Customs Appellate Tribunal has decided the case with remarks that appeal is accepted in the favour of customs department.
