Customs Appellate Tribunal upheld impugned order in impounded Mercedes Benz

LAHORE; Customs Appellate Tribunal has dismissed the appeal in impounded Mercedes Benz truck filed by the Fazal Badshah against the state through Superintendent I&P, Intelligence and Investigation-FBR Lahore and others.

Member Judicial bench-III Omer Arshed Hakeem heard the arguments and decided the case with remarks that tribunal concluded the hearing of appeal and same is dismissed and order in original is upheld.

According to the details of case, staff of Customs Intelligence and Investigation-FBR Lahore was intercepted a Mercedes Benz truck and after checking chassis number were found suspicious and tempered.

On demand, driver produce registration book and failed to produce document showing lawful import of vehicle. Said truck was sent to Punjab Forensic Science Agency for the test.

After the show cause notice, adjudication proceeding were culminated and order in original was passed with remarks that allegations in show cause notice is established. Appellant not satisfied with the order was challenged before the Collector of Customs Appeals who dismissed the appeal being devoid of merit.

Being aggrieved with order and challenged before the Customs Appellate Tribunal with the arguments that order passed by earlier authorities not according to the facts and passed in mechanical fashion without consideration of relevant laws and also liable to set aside but all allegations denied by the respondent.

After hearing arguments from appellant and respondent sides, Customs Appellate Tribunal has dismissed the case and upheld the order in original passed by earlier judicial forums
