Customs Appellate Tribunal upheld impugned orders on Wednesday

LAHORE: Customs Appellate Tribunal has dismissed 14 appeals and upheld the impugned order filed by M/s Seagulls International, M/s Salman International, M/s Anjum Brothers versus Superintendent of Customs and Additional Collector of Customs Lahore.

Zulifqar A Kazmin Member Technical-II heard the arguments from the appellant and passed the verdict  with remarks that the appellant has been rightly apprehended and impugned order is found to have been passed properly and lawfully. Therefore, all fourteen appeals having no merit are herby dismissed and the impugned orders are upheld as maintainable.

As per the brief facts of case, an information was received by the customs that some commercial importers including the appellant in connivance with their clearing agents were engaged in clearance of aluminum enameled winding were since long time by mis declaraing it as M/s Computer Patch Card Lead/ and causing huge revenue loss to the state exchequer. After the complete examination Customs team found that all consignments imported in wrong way and some other discrepancies found in it.

During the examination some mollified activities were detected and charged Rs21,05,138 in taxes and duties which is payable by the importer.

After the show cause notice adjudication proceedings are culminated and passed the Order-in-Original that the allegation by the examination authority stands established and customs authority recover the amount with Rs2,00,000 penalty.

The appellant challenged the impugned order before the Customs Appellate Tribunal on the grounds that impugned order not passed in judicious manners so liable to set aside. After hearing the arguments Customs Appellate Tribunal had dismissed the appeals.
