ISLAMABAD: Amir Shuja, a Pakistan Customs Service officer of BS-16, has been given minor penalty of ‘withholding of four annual increments with cumulative effect’ over inefficiency.
As per details, the disciplinary proceedings under Government Servants (Efficiency & Discipline) Rules, 1973 were initiated against the officer, posted as Appraiser at MCC Port Muhammad Bin Qasim, Karachi vide Charge Sheet dated 25.01.2016. Saadia Sheeraz, Additional Director, Directorate of Reforms & Automation (Customs), Karachi was appointed as inquiry officer to conduct probe on account of various acts of omission and commission committed by the accused officer constituting ‘inefficiency’, ‘misconduct’ and ‘corruption’.
According to the inquiry report, the charge of “inefficiency” was established against the accused officer. A show-cause notice dated 22.07.2016 was issued to the accused officer and he was also called for personal hearing by the authorised officer on 22.08.2016. After considering the charges framed in the charge sheet, inquiry report and other available record, the accused officer was found guilty of “inefficiency” under rules 3(a) of the Government Servants (Efficiency and Discipline) Rules, 1973.
The authorized officer imposed minor penalty of “with-holding of four annual increments with cumulative effect” upon Amir Shuja under rule 4(1)(a) (ii) of the Govt. Servants (Efficiency & Discipline) Rules, 1973. His performance allowance will also be stopped for six months from the date of award of the above minor penalty as provided in Para 7(ii) of the Performance Allowance Guidelines, 2015 and he will have to appear afresh for restoration of the same.
However on conclusion of the proceedings, the officer was reinstated and the period of his suspension with effect from 18.09.2015 onwards was treated as leave of kind due and admissible under the rules.
