Customs Court awards imprisonment, fine to accused involved in mis-declaration

KARACHI: Customs Court Judge Syed Faiz Rasool Rashdi awarded imprisonment till rising of the court and a fine of Rs 1 million to a suspect, Abdul Ghaffar Bhundi, proprietor of the M/S Bhundi Corporation, and acquitted other suspects, Sher Rehman and Mir Nawaz Khan, in a case of mis-declaration.

During the hearing, the counsels for the suspects and department, including special public prosecutor completed their arguments, after which the court announced its judgment.

“After pondering the evidences available in record I have reached to the conclusion that accused Abdul Ghaffar Bhundi son of Haji Muhammad is guilty of the offence as charged. The accused person is facing trail since 2012, therefore, I take a lenient view and convict and sentence him till rising of the court and impose fie of Rs. 10, 00,000 upon accused, and if fine amount is not paid the accused shall suffer for one year. Since charge is not proven against accused Sher Rehman and Mir Nawaz Khan, therefore, giving benefit of doubt they are acquitted from the charge.”

According to the prosecution, proprietor of the M/s Bhundi Corporation, Abdul Ghaffar Bhundi imported 7 units of old & used trucks brand Mazda & Hino from Japan which were declared as sprinkler tracks, however, during the examination were found old & used trucks which were not importable policy order 2010.

After the formalities, case was registered against the above accused persons as section 156 (1) (4-A) of the customs act, 1969.
