Customs Court directs IO to complete proclamation proceedings against accused

KARACHI: Custom Court Judge Syed Faiz Rasood Rashdi directed investigation officer (IO) to complete proclamation proceedings against the absconding accused persons namely Asmatullah and Naseebullah who were booked for attempting to smuggle non-duty paid Indian origin cigarettes.

During the hearing, accused Fazal Kareem was absent but his counsel was present and filed an application to condone the absence. The court granted the application. The accused, Muhammad Nabi and Khaliq Dar, were present in court on after arrest bail vide order dated 23/09/2016. However, the accused, Shah Muhammad Lali, was produced in court by jail authorities.

After the hearing, the court directed the investigation officer to complete proclamation proceedings under section 87 CRPC against the accused persons namely Asmatullah and Naseebullah who are still absconders in this case.

According to the prosecution, a case was registered on the application of Muhammad Jamali, inspector anti-smuggling organization Hyderabad under section 2 (s) 16 & 157 of the customs act, 1969 read with SRO 566 (1)/2005 dated 06/06/2005 punishable under clauses (8) (89) section 156 (1) & 157 (2) of the customs act 1969.
