Customs Court grants interim bail to owner of non-duty paid Toyota Land Cruiser

KARACHI: Customs Court Judge Syed Faiz Rasool Rashdi granted interim pre-arrest bail to accused person namely Moazzam Mazhar Faruqui son of Mazhar Faruqui who was booked in a case of smuggled/ non-duty paid Toyota Land Cruiser Prado jeep model 1996.

Court also issued notice to special public prosecutor for customs department and call police paper for April 1, 2017 and directed above named accused person to appear before the court on next date of hearing for conformation of his bail.

During the hearing, counsel for the applicant/ accused filed bail application, he argued that his client is innocent and falsely implicated in this case, therefore, court may grant his bail, after the arguments, court granted bail against the surety of Rs2,00,000.

It needs to be pertained here that on last date of hearing court had issued non-bail able warrants of accused Moazzam Mazhar Faruqui son of Mazhar Faruqui and Shujaat Ullah Khan son of Asamat Ullah Khan, now Moazzam Mazhar Faruqui came for bail, however, Shujaat Ullah Khan is still absconder in this case.

On last date hearing, Investigation Officer Muhammad Farooq had submitted interim challan before the court against above mentioned accused persons and informed that on credible information dated 19/12/2016 team of the Anti-Smuggling Organization impounded Toyota Land Cruiser bearing registration number FB-8154 model 1996 seating capacity 07 green colour (used) from near Jan Broast, Boat Basin, Clifton Karachi.

He further informed the court during checking documents of said vehicle, it was revealed that said vehicle was smuggled without payment of duty and taxes, therefore, vehicle was seized and case was registered against Moazzam Mazhar Faruqui son of Mazhar Faruqui and Shujaat Ullah Khan son of Asamat Ullah Khan in violation of section 2 (s) 32 and 178 of Customs Act 1969 punishable under clauses (8) (89) and 14 of section 156 (i) ibid.

After the hearing, court accepted interim challan and had issued non-bail able warrants against them, court also directed the investigation officer to complete investigation and submit final challan within reasonable time.

Names of Azhar Malik, Senior Preventive Officer Customs House Karachi, Faizan Zaidi, sepoy Customs House Karachi, Tahseen sepoy Customs House Karachi and Muhammad Farooq, Investigation Officer were mentioned as witnesses in this case in interim challan.
