Customs Court issues notices on acquittal petition filed by M/s Int’l Business Links

KARACHI: The Customs Court issued notices to special prosecutor for customs department on acquittal petition under section 265-K filed by Kashif Anwar, director of M/s International Business Links allegedly booked in a case of filing fake sales tax returns and issuance of fake sales tax invoices.

On 26 February 2020, during the hearing, counsel argued that in the instant case FIR was lodged against the applicant and others in the year 2011 without conducting proper investigation and applicant never applied for ID password for online e-fling sales tax returns and he has no concern with the filing of sales tax return after Dec 2007.

He further argued that court considering the facts and grounds acquit the applicant at this stage of the case as there is no possibility of conviction of the accused even if entire evidence in possession of the prosecution is adduced in the case.

According to the prosecution, during investigation it revealed that M/s International Business Links claimed inadmissible input tax on fake/ flying invoices amounting to Rs13,26,91,652 issued by various supplies namely New Galaxy, M/s SM International, M/s Tariq Package, M/s Universal Enterprises and M/s Zevis International who had also been nominated as accused in this case.

Investigation further revealed that IP address was login more than 42,000 time during the period from 2008 to 2012 and fake sales tax returns were e-filed of 282 fake units as mentioned in FIR and apparently in the case the ID and password has been misused by some fraudster persons who utilized the STRN and email ID of International Business Links during the period of 2008 to 2012.
