Customs Examiner punished for inefficiency, misconduct

ISLAMABAD: The competent authority has imposed the minor penalty of ‘withholding of annual increments for three years’ on Syed Farasat Ali Jaffery, Examiner (BS-16), Model Customs Collectorate of Preventive, Karachi, over inefficiency and misconduct.

The disciplinary proceedings under Government Servants (Efficiency & Discipline) Rules, 1973 were initiated against the officer and Nausheen Riaz Khan, Deputy Collector, MCC (Appraisement-West), Karachi, was appointed as Inquiry Officer to conduct inquiry on account of various acts of omission and commission committed by the accused officer constituting inefficiency and misconduct .

On the basis of Inquiry report submitted by the inquiry officer, the accused officer was served a show-cause notice. He submitted his reply to the show-cause notice, however, he did not avail the opportunity of personal hearing.

After considering the inquiry report and reply of the accused to the show-cause notice, the Authorized Officer/Chief (Mgt-Cust) found him guilty of ‘inefficiency’ and ‘misconduct’ in terms of rule 3(a) and (b) of the Government Servants (E&D) Rules, 1973, and imposed the minor penalty of “withholding of annual increments for three years” (without cumulative effect) upon the accused officer under rule 4(1) (a)(ii) of the Govt Servants (Efficiency & Discipline) Rules, 1973.

His performance allowance shall be stopped for 6 months from the date of award of penalty as provided in para 7(ii) of the Performance Allowance Guidelines 2015 and he will have to appear afresh for restoration of the same. On conclusion of the proceedings, he is deemed as re-instated and the period of his suspension from 19.06.2015 onwards has been ordered to be treated as leave of kind due and admissible under the rules.
