Customs Inspector Arshad given minor penalty over misconduct

ISLAMABAD: Muhammad Arshad, a Pakistan Customs Service officer of BS-16, has been given minor penalty of ‘stoppage of three increments without cumulative effect’ over misconduct.

The disciplinary proceedings were initiated against the officer, presently posted as Inspector at Model Customs Collectorate, Islamabad, under Government Servants (Efficiency & Discipline) Rules, 1973 vide Charge Sheet dated 13.10.2015. Saadiya Noori, Deputy Director, Directorate General of Intelligence & Investigation-FBR, Islamabad, was appointed as inquiry officer to probe into the account of various acts of omission and commission committed by the accused officer constituting ‘misconduct’ and ‘corruption’.

According to the inquiry report, the charge of ‘corruption’ was established against the accused officer. A show-cause notice was issued to the accused officer dated 26.02.2016 and he was also called for personal hearing by the authorised officer on April 12.

After considering the charges framed in the charge sheet, inquiry report, oral submissions made by the accused during the hearing and other available record, the authorized officer concluded that the inquiry officer in her report was not able to convincingly prove the charge of “corruption” under Rule 3(c) of the Government Servants (Efficiency and Discipline) Rules, 1973 against the accused.

The authorised officer has, therefore, imposed minor penalty of “stoppage of three increment without cumulative effect” upon Muhammad Arshad, falling on 1st December, 2016 under rule 4(1)(a)(ii) of the Govt Servants (Efficiency & Discipline) Rules, 1973.

The official was also reinstated into service with immediate effect and his period of suspension from July 28, 2015 till date will be treated as leave of a kind due as admissible under the rules. His performance allowance will be stopped for six months from the date of award of the above minor penalty as provided in Para 7(ii) of the Performance Allowance Guidelines, 2015 and he will have to appear afresh for restoration of the same.
