Customs Inspector Nadeem given compulsory retirement

ISLAMABAD: Muhammad Nadeem Bhatti, last posted as Inspector at Model Customs Collectorate (Appraisement), Lahore, has been given major penalty of compulsory retirement for misconduct.

As per details, the disciplinary proceedings against the accused officer initiated under Government Servants (Efficiency & Discipline) Rules, 1973. A show-cause notice was directly issued under Rule 5(1)(iii) of E & D Rules, 1973 dispensing with holding of inquiry through an inquiry officer/committee on account of his unauthorised absence from duty as the authorised officer was convinced that it was not necessary to conduct an inquiry through an inquiry officer on account of following acts of “omission” and “commission” constituting “misconduct” in terms of Rule 2(4) and Rule 3(b) of E & D Rules 1973:- i. That he was granted 365 days ex-Pakistan leave on half pay (LHP) from 13.06.2014 to 12.06.2015 to visit Canada vide FBR’s notification dated 06.06.2014.

The said leave was granted on the condition that he will not apply for extension on expiry of the leave. ii. After expiry of leave he was due for duty on 13.06.2015. Instead of joining duty the official applied for extension in ex-Pakistan leave for 180 days which was refused and he was directed through MCC Appraisement, Lahore to join duty immediately. However, he remained absent from duty.

The Chief (Mgt Customs), being the Authorised Officer in this case, after having considered all aspects of the case along with the written reply of the accused official to the show-cause notice that the charges of “misconduct” against the official stand established. The Chief (Mgt Customs) recommended imposition of the ‘major penalty’ of ‘compulsory retirement’ upon the accused in terms of Rule 4(1)(b)(ii) of the Government Servant (E&D) Rules, 1973.

On the recommendations of the authorised officer, the Member (Admn) imposed the major penalty of “compulsory retirement” upon Muhammad Nadeem Bhatti, Inspector, under Rule 4(1)(b)(ii) of the Govt. Servants (Efficiency & Discipline) Rules, 1973 with immediate effect. His absence from duty with effect from June 13, 2015 till the date of this notification will be treated as extraordinary leave i.e. leave without pay and allowances.

However, the punished officer has the right of Appeal as admissible in the Civil Servants (Appeal) Rules, 1977.
