Customs Peshawar asks police to hand over NDP vehicles to initiate proceedings

PESHAWAR: On the direction of the Supreme Court of Pakistan, the Model Customs Collectorate (MCC) Peshawar asked the local police to hand over the Non-Duty-Paid (NDP) vehicles impounded by local police for initiating the proceedings under the Customs Act-1969.

According to details given by Zakir Muhammad, Deputy Collector Anti-Smuggling Peshawar, that Honourable Supreme Court of Pakistan had made decision on the NDP vehicles seized by the police under Section 51, 523 and 550 of Cr.PC and disposal, thereof under section 516-A-Cr.PC.
He was told that it would like to bring into the kind notice that the decision rendered by Apex Court in criminal petition No: 802 of 2015 and criminal petition No: 27 of 2016 by declaring that the NDP vehicles impounding on the suspicion of being stolen under section 523 and 550 Cr.PC by the other law enforcing agencies may be handed over to the Customs for taking appropriate action under the provisions of Customs bylaws.
He told CT that the court further held that the learned Additional Sessions Judge could not have any authority/jurisdiction to give possession/superdari of vehicles to its owner when it is proved that the vehicle is NDP.
He further told CT that it is therefore requested to extend the assistance to the Customs Authority for smooth implementation of the decision of the Honourable Supreme Court of Pakistan and NDP vehicles by the local police may be handed over to Customs Department for initiating proceeding under the Customs Act-1969.
