Customs Secretary Ijaz Badshah dismissed over inefficiency, misconduct

ISLAMABAD: Ijaz Badshah, a Pakistan Customs Service officer of BS-19, has been dismissed over ‘inefficiency’ and ‘misconduct.’

The disciplinary proceedings were initiated against Ijaz Badshah, posted as Secretary at Federal Board of Revenue (HQ), Islamabad under the Government Servants (Efficiency & Discipline) Rules, 1973 in terms of Rule 3(a) & 3(b) ibid vide Charge Sheet/Statement of Allegations dated 26.11.2014.

Dr Zulfiqar Ali Ch, a Pakistan Customs Service officer of BS-20, was appointed as inquiry officer to probe into the charges levelled against the accused officer. According to the inquiry report, the charges levelled against the accused officer were established beyond any shadow of doubt. A show-cause notice dated 16.12.2015 under the Government Servants (Efficiency & Discipline) Rules, 1973 was issued to the accused officer, who furnished a reply dated 25.01.2016 and denied the charges levelled against him.

The authorized officer/Member(Admn) granted an opportunity of personal hearing on 17.03.2016 to the accused officer, however, he did not appear before the authorized officer for hearing. After having examined the relevant record, inquiry report submitted by the inquiry officer and written defence by the accused officer, the authorized officer found the accused officer guilty of all the charges mentioned in the charge sheet/statement of allegations dated 26.11.2014 and recommended to the Authority/Secretary, Revenue Division to impose a major penalty of “dismissal from service” upon the accused officer under Rule 4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973.

The authority/Secretary Revenue Division also accorded opportunities of personal hearing to the accused on 26.05.2016, 20.06.2016 and 05.09.2016, however, the accused did not turn up for personal hearing. The Secretary, after having gone through the case record and recommendations of the authorized officer found the accused officer guilty of the charges of “inefficiency” & “misconduct” as levelled against him in the charge sheet/statement of allegations and imposed major penalty of “dismissal from service” upon the officer under Rule 4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973 with effect from 07.10.2016.

The period with effect from August 09, 2014 to October 07, 2016 during which the accused officer remained unauthorisedly absent has been treated as extra-ordinary leave without pay. However, Ijaz Badshah will have a right to appeal to the appellate authority as provided under Civil Servants (Appeal) Rules, 1977.
