ISLAMABAD: Ijaz Badshah, a Pakistan Customs Service officer of BS-19, has been dismissed over ‘inefficiency’ and ‘misconduct’.
As per detail, the disciplinary proceedings were initiated against the accused officer, last posted as secretary at Federal Board of Revenue (HQ), Islamabad, under the Government Servants (Efficiency & Discipline) Rules, 1973, on account of acts of omission and commission committed by the accused officer constituting “inefficiency” & “misconduct” in terms of Rule 3(a) & 3(b) ibid.
The authorised officer/Member (Administration), having been satisfied that the charges against the accused officer were borne out of the record and were based on material evidence, dispensed with holding of a formal inquiry under Rules 5(1)(ii) & 6 of the Government Servants (Efficiency & Discipline) Rules, 1973 and proceeded against the accused officer under Rule 5(1)(iii) ibid by directly issuing show-cause notice dated 16.12.2015 for imposition of one or more penalties including a major penalty of “dismissal from service”.
After having examined the relevant record and written defence by the accused officer, the authorised officer found the accused officer guilty of all charges mentioned in the show-cause notice dated December 16, 2015 and recommended to the Authority/Secretary, Revenue Division to impose a major penalty of “dismissal from service” upon the accused officer under Rule 4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973.
The Authority accorded opportunities of personal hearing to the accused officer on May 26 and September 25, however, the accused did not turn up for personal hearing. The Secretary (Revenue Division), after having gone through the case record and recommendations of the authorised officer found the accused officer guilty of the charges of “inefficiency” and “misconduct” as levelled against him in the show-cause notice and imposed a major penalty of “dismissal from service” upon Ijaz Badshah under Rule 4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973 with immediate effect.
The period from August 09, 2014 to October 07, 2016 during which the accused officer remained absent will be treated as extra-ordinary leave without pay. However, Ijaz will have a right to appeal to the Appellate Authority as provided under Civil Servants (Appeals) Rules, 1977.
