LHC disposes of application against appointment of IR judicial member

LAHORE: The Lahore High Court (LHC) has disposed of an application against the appointment of Inland Revenue Appellate Tribunal Judicial Member Qamarul Haq Bhatti.

According to details, LHC Chief Justice Syed Mansoor Ali Shah heard the case filed by a petitioner, Mian Khalid. The counsel for the appellant argued before the court that the posting of the judicial member has been made directly by crossing the Federal Public Service Commission (FPSC), adding that appointing authorities did not advertise the post in the newspaper. He further said that appointment is against the law and LHC should declare the appointment of member null and void.

On the other side, Deputy Attorney General Mirza Nasar Baig argued before the court that the appointment has been made following the Income Tax Ordinance and it is not illegal and against the law.

According to the ordinance, the government has authority to appoint any lawyer, who fulfills the requirements for prescribed post, as judicial member, he added.

After hearing the arguments from both sides, the LHC disposed of the application against the appointment of member judicial.

Customs Appellate Tribunal: 

The Customs Appellate Tribunal division bench-II comprising Judicial Member Omer Arshad Hakeem and Technical Member Imran Tariq heard 12 cases and adjourned all the cases till next date of hearing.

The Customs Appellate Tribunal adjourned 12 cases including Pak Port International versus customs Lahore, Bico Iron and steel versus Directorate of Intelligence and Investigation Multan, Muhammad Afzal versus customs Directorate of Intelligence and Investigation Faisalabad, Tasleem Brothers versus Directorate of Intelligence and Investigation Multan.

On Thursday, Customs Appellate Tribunal heard cases, including Directorate of Intelligence and Investigation Faisalabad versus Hijveery Steel, Season food versus customs Lahore, Directorate of Intelligence and Investigation Faisalabad versus Bico Steel.

Furthermore, Tribunal heard Directorate of Intelligence and Investigation Faisalabad versus Hijveery Steel, Customs Faisalabad versus Atta Ullah, Jumma Khan versus Directorate of Intelligence and Investigation Multan, Directorate of Intelligence and Investigation Faisalabad versus Bico Steel, Abdul Karim versus Directorate of Intelligence and Investigation DG khan Unit.

In all cases the representatives of the appellant and recipient appeared before the court and argued in the favor of their respective parties after hearing the arguments from both parties Customs Appellate Tribunal adjourned the case till next date of hearing.
