Customs Tribunal declares OiR against Pak Foods as null & void

KARACHI: Customs Appellate Tribunal Bench-I has set aside the Order in Review no. 95/2015 on an appeal filed by M/s. Pak Foods regarding import of frozen chicken meat of China origin in the local market.

The Customs Tribunal, in its order, stated that the subject impugned Valuation Ruling 700/2015 dated 18-11-2014 lacks warrant of law and its issuance has no adherence to the statutory requirements as laid down in Section 25 of the Customs Act, 1969.

Therefore, the said Valuation Ruling is declared as devoid of any lawful authority, void, illegal and is set aside accordingly.

The order further stated that the impugned Order in Review passed within  the hierarchy of the Customs infested  with patent illegalities, is also held to be null and void  and accordingly set aside.

The respondents are also directed to follow the principles decided and observed by the superior courts in their judgments referred along with our additional observations made thereon in its letter and spirit, before  issuing any fresh ruling.
