LAHORE: The Customs Appellate Tribunals has disposed of an appeal of Barkat Agencies against the order of the Customs Adjudication Lahore.
As per details, Barkat Agencies, Sambrial Dry Port, Sialkot filed a case against director of Customs Intelligence and Investigation Lahore and collector of Customs Adjudication Lahore’s Order-in-Original No. 06/2014 dated February 6, 2014..
The Customs Appellate Tribunal bench-II comprising Member Technical Imran Tariq heard the argument of both parties and referred the case back to adjudication for reviewing the matter thoroughly.
As per detail, the said importer had tried to clear the consignment containing various items through mis-declaration of value and description of items on goods declaration No. SCSi-HC-460 dated January 1, 2014.
The staff of Customs Intelligence held the consignment on receiving credible information regarding the mis-declaration for examination.
During examination customs’ staff recovered stationery items, make-up kits, electronics, submersible pumps and auto parts and found that mis-declaration was committed by violating the Section 32(I) of Customs Act, 1969, punishable under Section 156(I) and imposed penalty of Rs 4 million approximately.
The tribunal received case and heard the argument of both parties after what case has been remanded back to adjudication officer for fresh decision after hearing both of the parties and receiving document they may produce.
