LAHORE: The Customs Appellate Tribunal decided a case filed by Ali Shah, a resident of Lower Dir, against superintendent directorate of intelligence and investigation-FBR Lahore and additional collector of customs (Adjudication) Lahore.
The tribunal declared in the judgment that after hearing the arguments and reading written record by the appellant as well as recipient, fact enumerates that the vehicle with registration No: C-2364 Dir was used in the transportation of smuggled auto parts. These auto parts were concealed under the gunny bags of potatoes. The tribunal hearing authority passed the order of outright confiscation of truck and dismissed the appeal.
According to the brief history of case, the staff of Directorate of Intelligence and Investigation (I&I)-FBR Lahore Hino six wheeler truck No: C-2364 Dir near Sherakot, Ring Road Lahore, was found loaded with potatoes.
On demand, driver of truck produced only bilty of consignment and driver failed to produce any legal document showing lawful imports of goods. The truck, with 103 bags of potatoes, was impounded under the provision of laws.
Appellant challenged the adjudication order before the Customs Appellate Tribunal on the grounds that order-in-original passed in the arbitrary manner and liable to set aside. The appellant also put many other points before the tribunal and prayed for declaring null and void the order of adjudication. The counsel for recipient denied allegations and prayed for dismissal of appeal.
After hearing of the case, Member Judicial Omer Arshed Hakeem of Customs Appellate Tribunal dismissed the appeal filed by Ali Shah.
