Customs Tribunal orders to release goods on payment of taxes, duties

LAHORE: Customs Appellate Tribunal decided case of Muhammad Omer a resident of Quetta versus Superintendent, Director of Customs Intelligence and Investigation- FBR Dera Ghazi Khan.

Customs Tribunal ordered to release the goods to appellant after payment of taxes and duties assessed by the Customs authorities.

As per details, Superintendent Customs Intelligence and Investigation-FBR Multan acting on credible information took action against foreign polyethylene that was being transported from Quetta to Lahore through truck no. TKE – 190.

The seizing party and FIU Dera Ghazi Khan intercepted truck near Gadai Chowk DG Khan. Un-indentified persons on four cars blocked the road and opened firing on staff and smashed truck but Deputy Director MCC Multan chased the truck, consequently smugglers escaped with driver.

A bilty was issued by Sitara Al Hamayon Goods Transport Company Quetta showing 860 bags of plastic dana and no more document of lawful import found as non-duty paid.

The Additional Collector (Adjudication) Model Customs Collectorate Faisalabad seized the truck on smuggling and non-payment of taxes and duties.

The Tribunal Divisional Bench-I comprising Ghulam Murtaza Bhatti Member Judicial and Khawaja Omer Mehdi Member Technical, after detailed hearing from both parties disposed of the case on judgment that the goods shall be released to the owner on payment of taxes and duties.
