Customs Tribunal upholds ONA in impounded container case

LAHORE: The Customs Appellate Tribunal has dismissed an appeal filed by Additional Director, Intelligence and Investigation-FBR Multan, against Nisar Ahmed, a resident of Multan, and Collector of Customs (Appeals) Lahore.

Tribunal Member has heard the appeal in detail and arguments made by the complainant and respondent and decided the case with remarks that the respondent has benefited from the purchase of goods and successfully set a record, so the appeal is dismissed.

The customs staff intercepted a truck loaded a container. On search, the container was found loaded with used but serviceable monitors of different brands. to query, the driver of vehicle failed to produce legal documents regarding the same case.

After a show cause notice, the Order-in-Original was passed by the adjudication authority that goods are seized outright.

The appeal was filed before the learned Collector of Customs (Appeals) who set aside the Order-in-Original passed by the adjudication authority.

Being aggrieved from the order, the same appeal was filed before the Customs Appellate Tribunal on the grounds that Order-in-Appeal was passed without the appreciation of law which is liable to be set aside but the respondent denied all the allegations.

After hearing arguments, the Customs Appellate Tribunal dismissed the appeal.
