Customs Tribunal waives off penalty on suspect imposed by adjudication

LAHORE: Customs Appellate Tribunal, Lahore has set aside the decision of Customs Adjudication Faisalabad by accepting the appeal of the truck owner, Inamullah Khan.

The appellant Inamullah Khan from South Waziristan had filed the case in Customs Appellate Tribunal against the Order-in-Original (ONO) passed by additional collector of Customs Adjudication Faisalabad, and additional director of Directorate General of Intelligence and Investigation Multan.

The details of the case explains that customs authorities received information that Bilal Auto Mobiles has evaded huge amount of duties and taxes through mis-declaration of description, quantity and the value of the auto mobile parts vide GD no KPPT-HC- 39728 dated 03-02-2015.

Therefore, MCC Multan conducted raid and intercepted the container near Maitla Chowk, Vehari as the driver could not produce any documents showing the legal possession against it under Section 2 (kk) and 17 of Customs Act 1969.

While deciding the case, adjudication asked the driver to pay 20 percent of the value of consignment to get release his truck.

Later, appellant moved the Customs Appellate Tribunal with the stand point that he is running a business of carriage and there is no allegation levelled against him in the show cause notice.

After hearing the case the tribunal decided that no mala-fide practice has been found in the case against appellant, so the appeal is accepted and 20 percent fine imposed is waived off.
