Deputy Collector Adjudication Khansa issues SCN to owner of non-duty paid goods

ISLAMABAD: Deputy Collector Adjudication Khansa Mehmood Chaudhary issued a show-cause notice with reference to a seizure case no: 111/2018 to the owner of smuggled red chilies.

Both the respondents, the owner of smuggled goods/vehicle and Collectorate of Customs Preventive Islamabad, have been directed to furnish the documentary evidence if any and present the oral arguments to substantiate respective position or claim.

Show-cause notice further stated that in case a party does not appear on the date fixed for hearing then the case will be decided after hearing the party present in the court.

It has been reported that information has been received by the Assistant Collector Customs Preventive Division Islamabad regarding the attempt of smuggling of misc. goods to inner Punjab.

During the checking at GT Road Rawat, the truck bearing registration no. 7561 was intercepted by the Customs Preventive staff for necessary checking, during searching of the vehicle the staff recovered juice (made in Iran) and red chilies crushed product of India. The driver of the said truck named Malik Abid Zaman, failed to produce any documentary evidence of the legal possession of the goods.

Therefore the customs staff arrested the driver on the spot and seized the goods along with the vehicle in term of section 168 of the Customs Act 1969 for the violation of section 2 (s) ,16 and 157 of the customs act 1969.

Meanwhile the in the light aforesaid report and in exercise of the power vested under section 171 of the Customs Act 1969, Deputy Collector Adjudication Khansa Mehmood Chudhary has issued a show-cause notice to the owner of the foreign-origin smuggled goods and vehicle as to why the seized goods shall not be confiscated and as to why the vehicle should not be impounded and why penal action should not be taken against him under Section 156 (1) (89) of the Customs Act 1969.
