Deputy Collector Dr. Wajid Ali orders to recover evaded duty & taxes from M/s Hammad Poly Industries

ISLAMABAD: Customs Adjudication Deputy Collector Dr. Wajid Ali has ordered to Customs Collectorate Islamabad, for recovery of evaded amount of duty and taxes to the tune of Rs5,00,000 in contravention case No. 28/2017 filed against M/s Al Hammad Poly Industries Industrial Estate Rawat, Rawalpindi and also imposed a penalty of Rs.1,25,000.

According to details, it has been reported that the Directorate General Audit (Customs & Petroleum) Lahore conducted the audit of the imports carried out through Islamabad Dry Port and  raised an audit observation that “the Directorate General Valuation Karachi has fixed the value of imported socks @ $1.66/dozen vide Valuation Ruling No. 309.

During audit of record of the DC, Customs, Imports, Dry Port, Islamabad for the FY 2013-14, it has been observed that 4,794 dozens socks imported by M/s Al Hammad Poly Industries under GD NO.873 dated 2.9.2013 have been assessed and released at rate lower than fixed by the DG, Valuation, Karachi. This resulted in short-realization of revenue amounting to Rs. 5,00,190/-.

Accordingly the demand notice raised, but the importer failed to pay the same. Hence the contravention report under the provision of section 32(3A) of the Customs Act 1969, is constituted.

Deputy Collector has said in Order in Original (ONO) that the charges leveled in the show cause notice of the instant case stand established. Therefore, I, order for recovery of evaded amount of duty and taxes to the tune of Rs. 5,00,190 in terms of Section 202 of the Customs Act, 1969 read with Customs Rules 2001, notified vide SRO450(I)/2001 dated 18.06.2001 and also impose a penalty of Rs1,25,000/- in terms of section 156(1) (14) of Customs Act, 1969.
