Deputy Collector Moeen Afzal Ali orders M/s Hino Autos to deposit evaded amount of duty, taxes

KARACHI: Collectorate of Customs Adjudication-I, Deputy Collector Moeen Afzal Ali has issued an Order-in-Original (ONO) against M/s Hino Autos for evading duties/taxes to the tune of Rs 637,472. Moreover, a penalty of Rs 50,000 is also imposed on the importer.

Hearing in this case was fixed for March 18, 2016, April 12, 2016 and April 28, 2016 but no one appeared from the importer side and Habibur Rehman and Mehmoob Dawood Vohra, appraising officers of the PCA appeared for hearing and defended the charges leveled in the show cause notice.

I have gone through the record of the case and reach the conclusion that importer made evasion of duty and taxes in consignment of liner for diesel engine and got their consignments cleared at lower value at $2/kilogram without application of Valuation Ruling No 661 dated 29.3.2014 issued under Section 25-A of the Customs Act, 1969 for $2.5/kg and made short payment of Rs 637,472. Therefore the charges leveled against the importer in show cause notice stands fully established.

The importer is directed to deposit the total evaded amount of duty and taxes immediately along with personal penalty of Rs 50,000.
