Deputy Collector Moeen Afzal issues ONO against M/s BuyDirect

KARACHI: Deputy Collector, Collectorate of Customs Adjudication-I, Moeen Afzal Ali has issued an Order-in-Original ONO against M/s BuyDirect (Private) Limited for claiming illegal benefits under SRO 549(1)/2008 dated 11.6.2008.

According to details, during audit of the import data it was revealed that M/s BuyDirect has imported energy saving tube light assorted watts and declared PCT heading 8539.3920 through MCC Appraisement West.

Accordingly, an audit observation of even number dated 17.2.2016 was issued to M/s BuyDirect explaining and clarifying as to on what basis concessions were availed by them even when the item imported by them was neither covered by description nor the declared PCT heading was covered under the SRO 549(1)/2008 dated 11.6.2008 read with SRO 502(1)/2013 dated 12.6.2013 at the time of subject imports and thus was ineligible for concessions accorded vide SRO 549(1)/2008 dated 11.6.2008 read with SRO 502(1)/2013 dated 12.6.2013.

The importers, however, failed to come up with any tangible evidence and explanation and they were also unable to refute the charges leveled by the department.

Now therefore, M/s BuyDirect is issued a show cause notice as to why evaded amount should not be recovered from them and penal proceedings should not be initiated against them for violation the law.

It is held that M/s BuyDirect intentionally and willfully caused loss to the government exchequer amounting to Rs 170,366 by illegally availing the benefits of SRO 549(1)/2008 dated 11.6.2008 which was evidently not admissible to them at the time of import.
