DG Customs Valuation rejects petition against VR No. 661/2014 of auto part

KARACHI: Director General of the Directorate General Customs Valuation Sumaira Nazir Khan has rejected a review petition against amendment to Valuation Ruling No.661/2014 pertaining to the ring set (auto part).

This revision petition was filed under section 25-D of the Customs Act, 1969 by the importer M/s Anwar and Brothers who requested the DG valuation to declare the said ruling void-ab-initio. The petitioner also demanded the court that “customs value for ring set may kindly be fixed at $3.50 per kg on basis of goods declaration and data available on record.”

The petitioner also claimed that “the respondent (director vaulation) issued the Valuation Ruling No. 661/2014 (File No. Misc/22/2009-VIIA) dated August 29, 2014, under Section 25-A of the Customs Act, 1969 without observing the legal norms and by ignoring the provisions of customs act.

On the other hand, respondent (Valuation Ruling department) while countering to the argument of petitioners’ counsel, stated that “the disputed amendment to the existing valuation ruling was in fact issued in pursuance of Order in Revision No 54/2014 dated 16.06.2014. It also stressed that the values previously determined were re-examined as per the aforesaid revision order and after having input and participation of representatives of trade body/stakeholders i.e. PASPIDA, necessary amendment was issued as per provisions of section 25 (9) read with section 25(7) of the Customs Act, 1969. The representative also stated that this ruling is being applied without protest from any other importers and is being widely accepted in principle.”

After analysing the facts of the case, DG Sumaira in her order stated “I find that besides the reason of non-prosecution, the petition lacks merit as the petitioners have been unable to substantiate their contention to disprove the validity of value determined through amendment in impugned valuation ruling. The petition is thus rejected accordingly.”
