FBR I&I to file appeal against Customs Court verdict

ISLAMABAD: Directorate General of Intelligence and Investigations Federal Board of Revenue (FBR) decided to file an appeal against verdict of the Customs Court in Islamabad High Court. Special Court of Customs acquitted M/s Smartzone and courier company TCS chief executive officers, directors from all charges.

Additional Director Abdul Waheed Marwat told Customs Today that after necessary process a final appeal will be filed in Islamabad High Court next week.

It is necessary to mention here that Korean company Samsung’s Punjab and Khyber Pukhtoonkhawa distributors imported huge quantity of electronics goods under the banner of Afghan Transit Trade (ATT). After detecting mis declaration Customs Intelligence team registered a case of smuggling against the top management of both companies. Customs Intelligence team also recovered smuggled electronics items from the Warehouse of M/s TCS.

Special Judge Sheraz Kiyani heared the case and acquitted the chief executive officers and directors of both companies from all charges. In its verdict Special Customs Court said that Customs Intelligence team obtained the search warrants from first class magistrate by the name of inspector but they send other send Intelligence Officer Shahid Majeed to conduct raid.

It is also necessary to mention here that M/s Smartzone and M/s TCS also filed petitions in Islamabad High Court praying to pay all duty and taxes which are payable on these electronics goods, but Islamabad High Court rejected this petition. On the other hand Customs Adjudication Director Dr. Akhtar Hussain also imposed a fine of Rs1 billion on both companies and directed Customs Intelligence and Investigation team to recover the outstanding amount from M/s Smartzone.
