FIR lodged against M/s Emmar Industries in sales tax refund scam

KARACHI: The Customs Court has directed investigation officer of Intelligence Investigation & Prosecution (II&P) Cell, Zone-I, Regional Tax Office-III, Karachi to submit progress report against Muhammad Muneer, owner of M/s Emmar Industries for committing tax fraud by claiming illegal/ input/ obtaining sales tax refund on strength of fake and flying invoices and false zero-rated supplies without having any manufacturing facility.

On 31 October 2020, investigation officer submitted that during the investigation, it was found that accused persons fraudulently got the sales tax registration as manufacturer whereas the said person does not have any manufacturer facility and does not exist at declared business address and claimed and got sales tax refund fraudulently on the strength of fake/ flying invoices where the description of goods does not match with the nature of business of the accused person.

He further submitted that based on these facts, it is concluded that the sole objective of the said accused person was to claim illegal sales tax refunds on local supplies, which directly comes under the scope of tax fraud as per section 2 (37) of the sales tax act, 1990.

He stated that first information report (FIR) is lodged accordingly and further investigation of owners of declared premises, buyers, suppliers and proprietors are in progress.

After the hearing, court took FIR into court record and directed investigation officer to complete investigation and submit progress report on next date of hearing.
