Royal Packages moves SHC against customs in Rs 438m tax evasion case

KARACHI: Importer Royal Packages (Private) Limited, which was issued the Order-in-Original for tax evasion of Rs 438 million plus a Rs 40 million penalty by the Collectorate of Customs Adjudication-II, had approached the Sindh High Court (SHC) against officers of the Research and Detection Wing of the MCC Appraisement-East even before the conclusion of the hearing.

According to details, in a written reply to the show cause Notice No. Adj-II/Coll/SCN-66/MCC-A (East)171-R&D/Royal Packages/2014 dated May 29, 2014 the Royal Packages lawyer, terming the charges malicious and ill-motivated, said that the client had already moved the SHC against the officials in Suit No. 863/2014 and CP No. D3233/2014.

In a para-wise comment the department stood by the charge that royal packages got 282 consignments of polypropylene and polyethylene through customs by making untrue declarations that the goods were to be used for manufacturing of mono-filament yarn and net cloth thereby claiming exemptions of customs duty, sales tax and income tax. The department also said that no negative order has ever been passed by the SHC against any officer of the Collectorate of Customs (Adjudication-II), Karachi.

The allegations are a mere effort by the Royal Packages to divert attention from the real issue of availing undue benefit of SRO 811(1)/2009 dated September 19,2009, the department rebutted.
