The counsel added that the field formation collected excessive tax from taxpayers during last three years. The petitioners approached the commissioner concerned many times for refunds but no action was taken in this regard.

At the end, the appellants decided to approach Federal Tax Ombudsman (FTO) to interfere in this case and direct the Lahore RTO to clear the pending refund claims as early as possible, the counsel argued, adding that the RTO Lahore should clear the refunds at the end of fiscal year but it did not do the same.

On the other side, counsel for RTO Lahore argued that the RTO has ready to settle the case after assessment. After hearing the arguments from both sides the Adviser of Federal Tax Ombudsman Mian Munawar Ghafoor  adjourned the case till next date for further hearing and directed the parties to appear on said date.
