The counsel added that the field formation collected excessive tax from taxpayers during last three years. The petitioners approached the commissioner concerned in Sialkot RTO many times for refunds but no action was taken in this regard by the Regional Tax Office.

At the end, the appellants decided to approach FTO to interfere in this case and direct the RTO Sialkot to clear the pending refund claims as early as possible, the counsel argued, adding that the RTO should clear the refunds at the end of fiscal year but it did not do the same.

On the other side, counsel for Regional Tax Office Sialkot argued that the RTO has ready to settle the case after assessment. After hearing the arguments from both sides Adviser of Federal Tax Ombudsman Mazhar Farooq Shirazi adjourned the case of M/s Jeway Madina Steel Furnace, Daska till next date for further hearing and directed the parties to appear on said date. Member FTO also seeks record in the case from both parties to finalize case as soon as possible.
