Generators seizure: Customs Appellate Tribunal ask to revisit case

LAHORE: Customs Appellate Tribunal sends back case a case Shahbaz Ali versus Collector Customs Adjudication Faisalabad to authorities concerned to look into the case and make recommendations according to law.

As per details, Customs Intelligence and Investigation- FBR Faisalabad intercepted a truck no.MNB 1674 loaded with foreign origin generators, on quarry the driver introduced himself as Amir Sohail from Sahiwal and produced a bilty number 500 and sales tax invoice on 19th June 2014.

The Adjudication authority called the owner of generator Shahbaz Ali who also failed to produced legal documents regarding import of generators the truck along with generators confiscated by the customs authorities under 156 (1) of customs act 1969.

Shahbaz Ali challenged the decision in Customs Appellate Tribunal on grounds that the Adjudication order was not according to law, generator was produced locally and  purchase receipt of generators is also available with the owner. The  customs department in their comment denied all allegations by the appellant.

The tribunal member technical Khawja Omer Mehdi heard the case and remanded back to the authorities.
