IHC adjourns hearing of reference filed by Haidri Beverages

ISLAMABAD: A division bench of the Islamabad High Court (IHC) has adjourned the hearing of a petition, seeking the court’s guidance in jurisdiction of the Customs Appellate Tribunal and Appellate Tribunal Inland Revenue (ATIR).

A division bench of the IHC comprising Justice Noorul Haq Qureshi and Justice Athar Minallah heard the reference filed by Haidri Beverages (Private) Limited.

The appellant had submitted a legal-proposition, asking the court to direct on the matter if the Customs Appellate Tribunal had the jurisdiction to hear cases of the federal excise duty and other special duties.

The appellant informed the court during Monday’s proceedings that it had filed a case relating to FED at Customs Appellate Tribunal, Islamabad and the tribunal declined to hear the matter mentioning that it could not hear such cases since they fall into the jurisdiction of ATIR.

After hearing initial arguments, the bench adjourned hearing of the case till April and directed the responding counsels to ensure presence before the bench on next date of hearing.
