IHC adjourns hearing of two tax references

ISLAMABAD: The Islamabad High Court (IHC) on Tuesday adjourned the hearing of two tax references involving the Appellate Tribunal Inland Revenue (ATIR).

A division bench of the IHC comprising Justice Noor Ul Haq N Qureshi and Justice Athar Minallah heard the case filed by M/s Mobizone Pakistan (Private) Limited. After the initial arguments on the submission the bench adjourned the hearing until the next date.

M/s Mobizone Pakistan had filed the case, seeking to restrict the Large Taxpayers Unit (LTU), Islamabad, from recovering outstanding tax amount from the petitioner.

Federal Board of Revenue (FBR), officers of LTU including Commissioner Inland Revenue, Commissioner Inland Revenue (Appeals) and ATIR were made respondent in the case.

Meanwhile, a single bench of IHC comprising of Justice Aamer Farooq also adjourned hearing of a case filed by M/s Khan Traders and General Order Supplier. The bench adjourned hearing following absence of of main counsels from the court.

In this case the appellant had also challenged decision of ATIR. The appellant had filed stay application against the decision of ATIR in which the tribunal had sustained decision of departmental adjudication.

The appellant had prayed the court to set aside the decision and direct the FBR field office to restrain from recovering the alleged outstanding tax amount.
