IHC adjourns Smart Zone’s case against Customs Intelligence

ISLAMABAD: After hearing brief arguments, a single bench of the Islamabad High Court (IHC) comprising Justice Miangul Hassan Aurangzeb adjourned the hearing of a case filed by M/s Smart Zone (Private) Limited until tomorrow.

The bench also directed the counsels involved to submit relating documents and argue in light of lawful grounds submitted through the petition.

M/s Smart Zone (Private) Limited had challenged actions of Directorate General of Customs Intelligence and Investigation before the IHC.

The appellant had challenged confiscation of goods allegedly were smuggled by the M/S Smart Zone Private Limited and some were dumped in godown near Lahore.

Interestingly, the Customs Appellate Tribunal had set aside decision of departmental adjudication by rejecting the allegations casted by the intelligence.

According to the Customs Intelligence, these items included: Samsung refrigerators, air conditioners, LED TVs, microwave ovens, and washing machines worth Rs 78.77 million were smuggled into country by evading duty/taxes amounting to Rs 50.87 million.

M/S Smart Zone had prayed the court to direct the department’s authorities that they must quash the proceedings against company being made in account of said case after the tribunal had decided the case in favor of the appellant.

Further, it had demanded the court to direct the department provide documents on basis of which liability is being sought by the department.
