IHC bars FBR from recovering outstanding amount from M/s Fauji Fertilizer Bin Qasim Ltd

ISLAMABAD: A single bench of Islamabad High Court reserved decision on a tax matter filed by M/s Fauji Fertilizer Bin Qasim Limited and restricted the Federal Board of Revenue from recovering liable tax amount from the company.

On 14.9.2018, IHC single bench comprising Justice Athar Minallah reserved the decision.

The appellant had challenged LTU notice for tax year 2012, dated March 3, 2016, under the head of sales tax under provisions of Sales Tax Act, 1990.

Earlier, another bench had disposed of a case from same appellant with directives to Large Taxpayers Unit, Islamabad of Federal Board of Revenue to decide M/s Fauji Fertilizer Bin Qasim Limited’s departmental appeal pending before the commissioner appeals within 60 days.

The bench had decided in favor of appellant who had challenged LTU’s order mentioning Rs1,412,291,114 as outstanding recoverable amount from the M/S Fauji Fertilizer Bin Qasim Limited.

In its decision, the bench had also restricted the FBR’s field office, LTU, form recovering the said amount till deciding the departmental appeal of appellant. The appellant had made FBR, and officers of LTU, respondents in the case.
