IHC bars tax authorities from recovering Rs 5.54m from M/s HEMS Corporation

ISLAMABAD: The Islamabad High Court (IHC) has barred the Regional Tax Office (RTO) from recovering outstanding tax of Rs 5.54 million from M/s HEMS Corporation.

A single bench of the IHC comprising Justice Aamer Farooq heard the case and also directed the Appellate Tribunal Inland Revenue (ATIR)  to decide the application of M/s HEMS Corporation within 30 days and submit a report before the bench.

The appellant had challenged a recovery order of the RTO issued on March 12, 2014. The RTO had demanded a payment of Rs 5.54 million along with penalty of Rs 443,931 from the company.

The order was issued under provisions of Income Tax Ordinance, 2001. Federal Board of Revenue (FBR), RTO’s chief commissioner, commissioner Inland Revenue, commissioner Inland Revenue (Appeals), assistant commissioner Inland Revenue and ATIR were made party in the case.
