IHC bench bars tax authorities from recovering outstanding tax from Wateen Telecom

ISLAMABAD: A single bench of the Islamabad High Court (IHC) has barred the Large Taxpayers’ Unit, Islamabad, from recovering outstanding tax of around Rs 173.6 million from M/s Wateen Telecom Limited.

A single bench of the IHC comprising Justice Aamer Farooq disposed of the case filed by M/s Wateen Telecom Limited and also directed the Appellate Tribunal Inland Revenue to decide the case within 60 days and submit a report before the court.

The company had challenged the LTU demand notice issued on February 2, 2016, asking it to pay around Rs 173.6 million under the head of income tax for the tax year 2008 . The LTU had issued the notice under provisions of the Income Tax Ordinance, 2001.

The appellant had claimed before the court that the demand notice was issued without hearing them, hence it must be declared illegal and in violation of law

LTU officers including chief commissioner, commissioner Inland Revenue, assistant commissioner Inland Revenue and Federal Board of Revenue were made respondent in the case.
