IHC directs ATIR to decide appeal filed by M/s LMKT within 60 days

ISLAMABAD: A single bench of the Islamabad High Court (IHC) on Friday directed the Appellate Tribunal Inland Revenue (ATIR) to decide the appeal filed before it by M/s LMKT (Private) Limited.

Justice Aamer Farooq of the IHC issued these directives, adding that the tribunal must decide the matter within 60 days in order to bring justice to the appellant.

Meanwhile, the court also directed authorities in the regional tax office (RTO), Islamabad, to abstain from actions aiming at recovery of outstanding tax amount of Rs 31,100,343 along with penalty of Rs 1,705,671 from the appellant’s bank account.

The appellant had challenged RTO’s recovery order of said amounts under provisions of Sales Tax Act, 1990 and Federal Excise duty Act, 2005.

Federal Board of Revenue (FBR), RTO’s Chief Commissioner, Commissioner Inland Revenue, Assistant Commissioner Inland Revenue,  and ATIR were made party in the case.
