IHC directs ATIR to decide M/s Hi Wings Travels plea within 45 days

ISLAMABAD: Hearing a tax petition, the Islamabad High Court (IHC) has restricted the Regional Tax Office from realizing the outstanding tax of Rs 3.9 million from M/s Hi Wings Travels and Tours Operators (Private) Limited.

A single bench of the IHC comprising Justice Aamer Farooq heard the case and also issued directives to the Appellate Tribunal Inland Revenue to decide the appellant’s application pertaining to the tax claims within 45 days.

Justice Aamer Farooq issued these directives, adding that the FBR must abstain from recovering the outstanding tax amount claimed by the RTO for the tax year 2013.

The RTO had issued the order creating demand of the amount on May 28, 2015 which was challenged at the department, then at the ATIR and lastly before the IHC. The FBR field office had created the demand under provisions of Income Tax Ordinance.

The FBR, RTO’s Chief Commissioner, Commissioner Inland Revenue, Commissioner Inland Revenue (Appeals), Assistant Commissioner Inland Revenue and ATIR were made party in the case.
