IHC directs ATIR to decide Rs 2.8 m ‘tax evasion’ case with 60 days

ISLAMABAD: The Islamabad High Court (IHC) has directed the Appellate Tribunal Inland Revenue (ATIR) to decide the appeal filed by M/s Dowell Schlumberger (Western) SA (Private) Limited within 60 days.

Justice Aamer Farooq issued these directives while concluding the hearing of tax reference, in which the appellant had challenged the demand of about Rs 2.8 million on June 11, 2014 for the tax year 2011-12 under the provisions of the Federal Excise Duty Act, 2005.

The Federal Board of Revenue (FBR), Deputy Commissioner Inland Revenue Large Taxpayers Unit, Islamabad, Commissioner (Appeals) and ATIR were made respondents in the case.

The court also accepted the appellant’s appeal that the court may restrain LTU from recovering the said amount from the company’s bank accounts under the head of outstanding federal excise duty and directed the department not to make any such endeavour until the case is decided by the ATIR.
